It’s no surprise that Joe Biden wants to confiscate guns from law-abiding Americans. He’s very open about it, particularly when it comes to disarming citizens of so called ‘high-capacity magazines” and “assault weapons.” But the question was whether or not he would really be so brash as to attempt to go through with the largest confiscation scheme in the history of the world, seeking to register and confiscate over 40-million Americans’ guns with the stroke of a pen.
It’s a move from the playbook of his Vice President Kamala Harris, who said as a candidate for the Democrat Presidential ticket that she would issue an executive order to ban most firearms in America.
Of course, wielding executive orders as royal edicts is illegal, but that doesn’t stop the Progressives from waging war on the Second Amendment in the greatest capacity they can muster. The magazine limit for instance, wouldn’t just apply to rifles, but handguns as well, meaning that millions of gun owners would become felons overnight if the Democrats had their way, since the majority of pistols made since the 1960’s carry more that the magical ‘safe’ number of 10 rounds per magazine.
While Democrats haven’t been able to muster the legislative majority they need to pass sweeping anti-gun laws through the legislature, they are instead tweaking existing regulations in sinister ways to turn law-abiding citizens into felons overnight through the power of the Bureau of Alcohol, Tobacco, and Firearms (BATF).
The BATF has proposed by request of President Biden that firearms modified with stabilizing braces be deemed illegal. Owners of such weapons would be required to register, hand over, or permanently disassemble the guns, or else face federal felony charges. The government estimates that this rule would affect approximately 40 million firearms currently in public hands.
Alex Bosco, the inventor of the pistol stabilizing brace, explains that it is by far the greatest firearm “registration, destruction, and confiscation scheme” that has ever been proposed in America’s history.
The rule is an adjustment to a complex system by which the BATF judges whether a pistol equipped with a stabilizing brace should be classified as a short-barreled-rifle or if it remains a pistol in legal terms. Short-barreled-rifles (SBR’s) have been strictly regulated by the BATF since the 1934 National Firearms Act (NFA) was passed. For over a decade, pistol braces have been on the market, with the BATF deciding whether or not a certain brace on the market qualified as a brace or a stock on a case-by-case basis, creating an air of uncertainty for owners of such devices. The process by which the BATF decides has been criticized by gun industry members as frequently being arbitrary and sometimes contradictory.
Biden’s executive order would simply declare that all stabilizing braces make a weapon an SBR, falling under the regulation of the NFA. This would mean that every owner of a stabilizing brace — again, estimated at 40 million Americans — would have to pay a $200 tax, submit fingerprints, and register the weapon on the BATF’s NFA registry, or otherwise permanently dismantle or hand over the weapon.
Gun Owners of America’s Director of Federal Affairs, Aidan Johnston called Biden’s decree a “gross abuse of executive authority.”
The Democrats are always seeking for backdoor ways to regulate firearms since they cannot do it by ordinary legal means. You can still offer your opinion on the proposed ruling to the ATF at the following link. ATF must consider and respond to all relevant comments before proceeding. The important thing to remember if you submit a comment is that it must be worded politely and be topical.
